Since the lapse in appropriations on October 1, 2025, the court has operated using carryover and no-year funding. As these funds are no longer available, on October 17, 2025, the court must cease non-essential operations as required by the Anti-Deficiency Act. Case processing is an excepted constitutional function, and the court will remain open for all case related activities as described in General Docket Order No. 2023-9. This includes docketing new cases, receiving documents for filing, determining motions, hearing cases on submission and by argument, and deciding appeals. Parties remain obligated to comply with the filing requirements of the Federal Rules of Appellate Procedure and this court’s Local Rules. Cases currently calendared for oral argument will go forward as scheduled and filing dates will not be automatically extended.
